I was charged with felony grand theft auto for being a passenger in a golf cart?

this is really stupid. i was in California (Placer County) My buddy got permission from someone who apparently didn't own the golf cart to "take it for a spin" so we did i never drove the golf cart and 5 mins after driving it around security stopped us and accused us of stealing the golf cart... they called the cops and they arrested both my buddy and i for felony GTA... I have never been in trouble with the Police and are intentions were definitely NOT to steal it and the person who gave us permission vanished (key was in the golf cart)... we didn't damage anything... what are the chances of this being dropped? or moved to a mistiaminer I already spent 2, 000$ bail should i get a lawyer? or would a public defender be ok?... like i said before i have a clean record and have never been arrested or in trouble... i have a job and College degree and no need to steal a golf cart and i think the golf course blew this way out of preportion... thanks

I would be very surprised if this is filed as a felony, and I would be very surprised if it is filed as a theft. If you were just driving around on the golf course, I would expect a misdemeanor charge of violating Vehicle Code section 10851 (driving a vehicle without the owner's consent). You don't get you choice between hiring an attorney or having counsel appointed -- counsel is appointed only if you cannot afford to hire an attorney. But you certainly want to be represented anytime you appear in court on a criminal charge. A disposition for something less than a criminal conviction is always possible.BTW, if the prosecutor files charges, the vehicle owner cannot drop them. You can be convicted of the offense even if you were not driving if you were aiding and abetting the driver.

First, get a lawyer. Do not place yourself at the mercy of a PD.I don't see how those charges could stick, as (a) you weren't driving, and (b) you did not attempt to remove the cart from the property and (c) the relatively low value of a golf cart.With a good lawyer, you could get the charges reduced to unlawful use of property (MM), disorderly conduct (MM) or even get the charges dropped.

Yes get a court appointed lawyer.This case can be appealed as you being a Vitim .If you have anyone other than the two of you heard the permission being given.

Did your buddy apologize to the owner (who could drop charges anytime) and explain your innocence. JA could also take a plea and get you off. what is the truth. Worst case sceanario malicious mischief
